zero zero three two eight one sixty one oh two ridge avenue richard demarco is the attorney
they're being promoted to panelists here
good morning everyone good morning sir could you please state and spell your name for the
stenographer certainly richard demarco last name spelled d-e-m-a-r-c-o right do you swear
affirm that tell the truth, the whole truth, and nothing
but the truth? Yes, I do.
Mr. DeMarco, I have a letter of
unanimous support from Central Roxburgh
and a letter of support
from the Roxburgh Development
Corporation. Our vice chair
has a few questions for you, sir.
Good morning.
Have you submitted your documents in a zipist
14 days in advance of this hearing?
Yes. Okay. And do you waive the
reason to know your refusal and stipulate to its accuracy?
Yes. All right. Thank you. You can see your screen
and proceed. Thank you.
Thank you, Mr. Chairman. Yeah, we met with Central Roxborough. I do want to mention that
we received such a nice letter from them. And now why do I not see a share screen? Oh,
here it is. Sorry. It's right here. So hopefully you could see the refusal. But anyway, we did
receive a really glowing letter of unanimous support from the neighborhood group from Jax
over at Roxborough and also the other RCO as well. I'll show you that in a minute. So basically
what happened with this matter, Mr. Chairman, and this is a long-standing business front on Ridge
Avenue. There was an L&I sweep of all of the businesses up and down Ridge Avenue, and they
were looking for zoning issues. There was a glitch in this one. I hope you agree with me that's what
it was. Basically, they've been there as a business for at least 10 years. It's been a business prior
to that, dating back to the 1950s. I'll show you some photos. So it says building services. It's
basically more like office space, although there is some storage in the basement. But it's really
just the operation of a plumbing business. So Ellen and I kind of insisted that they would get
a variance for building services, even though it's mainly an office use. So that's the refusal. But
We'll stipulate to the accuracy.
It is a plumbing business, so technically I think that can fall into the definition of building services,
but it's mostly office space.
You'll see that in the photos.
I'll show you in a minute.
I'm going to skip over the PIF form and the petition of appeal,
but the storefront is very well maintained.
They decorate for the holidays.
It's Tinnany.
Carol Tinnany is my client.
She is here.
She's here. She is the owner. She can accept my testimony in a moment.
She is the owner.
She can accept my testimony in a moment.
But it's basically. Oh, and there are residential units in the rear, Mr. Chairman.
They are fully legal. There's permits. There was a rental license, but they because of the there was a violation on this business.
They held the renewal of the rental license, but they're all legal units in the back.
And we did get an amended refusal in order to make sure they were stated as existing uses on the property.
But this is what you have in the inside.
It's a very small space.
I'll show you a very rudimentary floor plan in a minute.
But it's really office space, although, again, as I said, there's some storage.
So those are the photos.
Here are the unanimous support letters from both RCOs, Central Roxborough Civic.
And we had a nice in-person meeting on this. And here's the letter from Jax over at Central Roxborough. Full support, unanimous. The business is well-liked, well-supported. They're a member of the community. They're not invisible.
They and you could see that with Jax's writing here.
Anyway, there was I was impressed by the tone of the letters, frankly.
Anyway, I'll show you the the prior permits and then I'll ask Carol to raise her hand in a minute to set my testimony.
But let me just show you the prior. There's the deed.
Let me just show you some of the prior permits.
So you see this is a long history of all sorts of business uses.
There was actually a tattoo parlor there, Mr. Chairman, and members of the board.
You see it here.
There was a tattoo parlor there.
There was actually a fishing, a bait store in 1995.
You see the stamp permit here.
And I'll just quickly show you the, this is the floor plan.
You see it's really, this is in inches, by the way, these numbers.
it's really a small uh two story a two uh two room office space with some storage in the basement
but we're fine with the um the lni um definition and we need we do need to to satisfy a violation
so this is the variance that we need and you see here again the tattoo tattoo shop and the
bait shop and actually there was see if i can do this i got there was a plumbing business there
way back in the 50s here's you should see this on your screen it says plumbing and heating shop
and the date is 1954 so i think you get the point uh obviously um there is a hardship because the
business it's been a long time um business use and it's had a long history of plumbing and
a bait shop a tattoo parlor and the only reason why the permit was not obtained the the applicant
had no idea that they weren't legal, having known about the long history of business and
construction, not construction, but unusual business-type uses in the past for decades.
So let me ask Carol Tinnany to raise her hand virtually, and I'll have her accept my testimony
and we can take questions.
They're promoted to panelists here.
Good morning.
Carol, can you hear us?
Make sure you're off mute.
Carol?
She might be joining.
Yes, I'm on mute.
Good morning.
Could you please state and spell your name for the sonographer?
Good morning.
My name is Carol Tittany, C-A-R-O-L-T-I-N-N-E-N-Y.
You swear or affirm to tell the truth, the whole truth, nothing but the truth?
Counsel?
Carol, did you hear my factual presentation and otherwise presentation to the board today?
I did.
Is it true and accurate?
It is, absolutely.
Okay, and can you adopt everything I said as your official testimony in this matter?
Yes, everything is correct.
All right.
And, Mr. Chairman, we can answer questions at this point.
Questions from the board.
Questions from our attorney.
No questions at this time, Mr. Chairman.
Questions from the comments from the virtual audience.
No hands at this time, Chair.
Planning Commission.
thank you chairman and good morning david effecto f-e-c-t-e-a-u with the city planning
Thank you, Chairman, and good morning.
David Fecto.
you share a firm to tell the truth the whole truth and nothing but the truth yes sir i do
please proceed thank you sir chairman and board members the comprehensive plan recommends no
change to the cmx 2.5 commercial mixed use zoning at this location the city rezoned this neighborhood
in 1982 in a council-supported map change.
This appears to be a legalization of a long-standing business.
The City Planning Commission recommends the board grant the proposed use variance for building
services.
