don't have a letter so i don't if there's no records for me to look at but we did it october
27th we you know we have proof of mailing that went to 98 addresses and their application for
zoning variance as long as along the notice of refusal in the project information form showing
the corporate entity owns the property and then certificate of tax clearance my clients are
actually paid a little bit more than they needed to so i would ask that either the corporate
representatives virtually raise their hand hopefully the community representative kimberly
is on and she'll tell us what how they voted all right why don't we do this first bring him on
yeah owner what's his name uh it's either nikolai or bogdan okay
excuse me is it okay does his last name start with a g yes i see him right there
okay yeah he's muted i i'll mute yourself sir
you're muted
nicolai could you unmute yes can you hear me yes i do please could you please state and spell your
name for the stenographer nicolai gerasim n-i-c-o-l-a-e gerasim g-h-e-r-a-s-i-m do you
swear or affirm to tell the truth the whole truth nothing but the truth yes counsel uh nicolai you
heard everything i had to state today about your zoning matter yes is it true and correct yes and
do you adopt this your own testimony yes specifically would you agree to proviso that the
trash would be stored outside in the rear yes thank you questions from the board yes what's
the width of the property the total width well uh let's see the width i have it as 43 feet three and
one eighth inches. Okay. All right. So my question is, can we go back to these floor plans?
All right. Okay. So the first floor, you've got two bedrooms, is that?
that's correct it's right here you come in that side and then you have the two bedrooms right here
okay and where's the bathroom you said well that one is only good for one of the bad bathroom uh
bedrooms it's right here in the corner it's hugged in the corner okay right across from the kitchen
yep it's a galley type of kitchen okay all right so then here for the second and the third floors
am i seeing three bedrooms he's he's putting three bedrooms in there okay originally they
are three bedrooms i'm sorry so nicolai what did you say originally is built three bedrooms
originally upstairs originally had three bedrooms yeah i think the only thing we're really converting
is that first floor which was is that correct nicolai yes the first floor it's uh open up
um i mean the separated with like rooms in the back and we're gonna do a little bit different
but the second and the third floor stays the same all right how much square footage are we talking
about uh let me see what our calculator actually i don't think we did calculations um but i have
to take a look at the building footprint i mean we have an occupied area of 53 and so let's say
55 percent and the lot area is around like 11 25.
And the lot area is around, like, $11.25.
So, yeah, I mean, it's a little small.
Yeah, for three bedrooms.
I mean, you can see it.
Yeah, it is a little small.
One of the bedrooms is smaller than the bathroom.
Well, they're not the scale.
He's already.
I know, I know.
but but but nikolai you know you are testifying that you have been in this property and that they
have been three bedrooms they're currently uh compartmentalized as three bedrooms up on the
second yes and each individual bedroom upstairs because it's like a narrow angle corner building
you cannot visualize it from the plants but the the size of each bedroom it's decent we have other
rentals is not small i don't know what it says on on zillow as a building but when i stepped
inside is none of the rooms they look like a baby room or an office they're all three bedrooms like
nice size bedrooms with closets with two or three windows on each bedroom so they look like a legit
size. I'm not concerned about how it looks. I'm concerned about square footage. What are we
talking about here when you say these look big? Well, so I asked you this, Nikolai, you have,
you came, you are on the, you've been in the property. Are we fitting a twin bed here,
a full bed a queen or king i the master bedroom definitely a king and the other ones you can fit
easy like a a twin or a queen it's like a decent size the only thing it's the corner is uh it's
gonna make you arrange the bed on one side or another because on the front of the property
is not square it's a narrow angle that kind of enlarge on the front and and goes a little bit
in the back what is the the fire staircase on the back yeah and you're not making any
structural changes here no everything stays the same yes it is divided into three units currently
yes again i i didn't get any square footage so it just looks awfully small well if the
occupied area is approximately a little over 605 square feet what uh well i mean it just says the
occupied area is sick yeah yeah yeah it should be more than that we have duplexes that like
1500 square foot for two individual bathrooms each but this one looks way bigger i have to
look on on zillow i'm sure the the the number that we purchased this under i don't have the
deeds in front of me right now but i'm positive it's like it's way bigger than a regular two
bedroom uh uh duplex size i own multiple duplexes and they nice size bedrooms inside did you say
the layout for this for the second and third floor are staying staying the same yes everything stays
the same photos from it originally um let me see what i got here actually i know we have to delay
how to stay in the same that would give us a idea yeah where did he purchase this uh he purchased
this property um hold on a second he purchased this property march of 2026. so uh nick i just
want to go from the beginning oops i have that hold on one second i just want to make sure i get
all right so nikolai i'm showing pictures here can you explain what i i would think that this
is one of the bedrooms right here right yes so you see the way the corner on the left you have
that blue carpet and it's a window over there that's kind of like going from the front of the
building looking in the back and it's it's a narrow as a bedroom in the back but enlarges it
on the front so i will think it's easy like probably like around 200 square foot
room to do something easy and it's a middle room over there but the
when you step inside because the building is narrow it's not square
on the front it sits on the corner plot on facing two streets and the way they did the brick on the
front from the foundation up it's it's angled it's not the square property yeah and then what
yeah and then what what's this picture here is that the like the all-in-one room like the living
what's this picture here is that the like the all-in-one room like delivery
room area this one is another bedroom over there with two closets and a ceiling fan and probably
this looks like a bigger one like a master uh bedroom and here we have probably what's left
from the kitchen just that old that's that galley kitchen there yes the galley kitchen and the door
in the back gets outside to the metal staircase the fire staircase to the outside and this is the
kitchen exit the bathroom that exists on either the second or third floor right yes all right and
then i think i have some more photos here and then uh what's what's this right here i'm circling
is this the is this the living room area
this is uh probably the middle the middle room and probably this one is on the uh
the ground level floor because the windows are smaller and they're all the way up
all right what about this once i write them circling right here
this is the middle bathroom usually those middle bathrooms they have two windows gotcha and then
this is the i guess the other bathroom yes and i guess this what what's what's the significance of
this picture why did we show this one do you know what that is which one oh this is the staircase
to show like we have a wide staircase that goes all the way up probably like uh 36 to 38 and it's
large to feed any couch to take it all the way up all right and i think oh well here what this is
the basement this is the the ground floor that has uh two rooms on each corner and an open concept
uh kitchen living room all right but original that's not the when you said basement let's be
careful that's not no it's not a basement it's the ground floor the the street level okay and then i
i mean we can go through each picture if you want so so so so let me yeah it really doesn't you know
it's nice to see the pictures but we still don't know how big they are right i mean no we have so
so so here's where i'm going to be i'm going to go to the get everybody else and then i'm
i'm going to close it because what i'm going to do is we're going to wait for
the letter from the uh rcl i think she there's someone who great there then we'll see right
Yeah, I think one way or the other, I think we need to at least see, I don't want to say draw, but the measurements of these rooms, instead of sitting here saying, look at this, look at that, and I'm going to hold this, I guess it's to the 16th.
Am I right?
We would vote on this on the 16th at 2 p.m.
Yeah, well, and Nikolai, can you give, can we take those floor plans and you can give me the dimensions of these rooms?
definitely i can do that tomorrow or you know i have it fax um emailed to you right away my concern
is it's it's it's too dense yeah i mean okay my concern i i i could understand two bedrooms maybe
but three bedrooms um it seems a bit and if it doesn't make sense we'll look at it but i think
it's the devil's in the details and use i mean it's we're not creating anything from scratch here
but we'll make the measurements and if it looks strange then we'll let you know all right any
other questions uh bill i just i'm sorry mr chairman i just want to let you bill's okay
shouldn't have done that um i just wanted to let you know on the chat that there's an objector
and a lawyer sure i just wanted to let you know for this yeah so what i'm going to do now is i'm
going to go to the to there then uh we'll see where we go okay i did have a question before
we jump to the audience my question is about trash and i know you said that you thought that
the basement was going to be used possibly for the owner um but what's the trash plan because
there's no really space at the rear to fit a dumpster and there's no trash closets on the plan
because no there's none we were expecting to do it right under the the fire escape we think there
is enough room there because there's a common driveway and if you look there it looks like
there's we're not touching the driveway but i'll show that picture one more time i think one thing
that would be useful not to no we don't think we need a plan but to understand the where the
property sits in the actual meets and bounds of the property it's or where the building sits in
the meets and the bounds of the property um because from google it's hard to see where the
public driveway starts in their property stuff yeah i mean what we can do also is we can go on
atlas they have measurement measuring tools on atlas i can kind of show you like you know how
far we are and you know that will be helpful all right yeah all right questions or comments from
Questions or comments from the virtual audience?
the virtual audience i'd say bye
Yes, Chair.
There are three hands up.
The first one is Kia Kaplan.
Is she the RCO?
We got two more, then we can go to the end.
We got one more at a time.
Hello.
Actually, hi.
My attorney's on, so you probably wouldn't talk to him.
him david ritchie your your husband's there no my my attorney david sure though sure put your
attorney on him you know okay i'm bringing him well do we bring him on as an attorney if he's
saying he's represents them he's not just a what uh a calling right he's a he's a uh he's an attorney
for the app for uh right so why don't we bring him on what's his name david ritchie all right
mr ritchie he should be on now sure yes good afternoon members of the board david ritchie
could you please state and spell your name for this sonographer yes sir uh d-a-v-i-d last name
ritchie r-i-t-c-h-e-y you swear or affirm to tell the truth the whole truth nothing but the truth
yes i did could you tell me who your client is sure um i'm an attorney with full and air we
We represent an Edward Kaplan and a Martin Kaplan.
Do you want to bring a witness on?
Do you want to present your case?
Not at the moment.
We're actually just here.
We felt obligated to appear here today to just reserve our rights to object and also
just to ensure notice of claims held by Edward Kaplan and Martin Kaplan.
There's a little bit of history that I have to give on this Edward Kaplan and Martin Kaplan.
This property was devised to Edward Kaplan under a will.
That will was blocked by a court order, and a Cordell Kaplan was appointed administrator.
While Administrator Cordell Kaplan purportedly sold the property after that purported sale occurred,
the order appointing Cordell was vacated and voided for lack of jurisdiction.
So we felt obligated to appear here today to just ensure that we have notice to Sibiu.
We sent notice on about July 6th to Sibiu just to advise of our position on it
and the question of authority of Cordell Kaplan due to the vacating of the order
that had appointed him as administrator and who had reinstated uh martin kaplan our other client
as executor of the estate um but in the meantime it was sold to the person in the meantime so it
was sold while cordell was appointed administrator but then the order appointing him was vacated for
lack of jurisdiction um and i've i can present those orders in screen share if but i mean tell
me what that has to do with where we are right now counsel that means that well it's contesting
ownership of the property because who his client bought it uh someone who maybe didn't have legal
authority to actually sell it so that title to the property appears don't know yeah appears to
be in question so that his client may not have standing yeah and this is the first well we do
have standing because we're the legal currently we're the legal owner of the property if anything
there may be other proceedings that don't relate to the zoning saying this is not a proceeding for
this no it's not but but i would say this is the first i'm hearing about this so if mr ritchie
uh can reach out to me uh and email me at alan.nockamson and knockamson.com we're holding
the vote anyway and i can talk to him not voting on this thing yeah but but i will say that this
is not the proper form for those proceedings you can grant the zone the zoning variance oh yeah
We don't necessarily take a position on the zoning matter today.
We don't have too much information about this.
We just learned about this earlier this week, I believe Sunday or Monday.
But, yeah, so we don't have a position on that, and we understand this is a zoning matter,
but we just felt obligated to appear here today and ensure notice of our position.
Listen to me one minute.
Why don't you do this?
We're going to hold this, right?
And in the meantime, why don't you talk to Mr.
Alckmson and work out that other issue on the side.
I'm not going to vote on this for a couple of weeks.
OK. And we made note of the the September 16th.
So thank you. Yep. Yep.
Is there anyone else in the virtual audience?
Yes, there's a hand up from Martin Kaplan.
Well, this Martin Kaplan is your client.
He is, sir. You want him? Are you calling him? I'm not, I'm not going to. I do not intend to call him today. Prepped him as any other hands.
He is. Sir.
